QUESTION 1 Under the Entertainment Act 2015 (fictitious), the Minister of Communication and Multimedia is empowered to make regulation regarding the administration of Malaysian singers. Section 5 of the Act provides that before making such regulations, the minister must consult the Malaysian Singers Association (MSA). Based on power given, the Minister passed a regulation named Entertainment (Artistes and Singers) regulations 2016. The regulations made by the Minister have following provisions inter alia; -

Regulation 3: The Singer must at least be 175 cm tall Regulation 6: All singers are required to contribute RM5000 annually to the MSA Regulation 9: Only Malay singers can have their own concerts in Malaysia.

Richard Lam is a popular singer in Malaysia. However, he received a letter from the Ministry of Communication and Multimedia which compelled him to give up his singing career because his height is only 169 cm
