Question:
For the elements and summary of the law for common law marriages, apply it to the facts below.
Facts: Mandy Johnson and Carl Lawrence met in middle school and fell in love. Mandy was two years older than Carl. Throughout their high school matriculation they were exclusive and knew they wanted to marry someday. On prom night in Mandy's senior year, Mandy and Carl had sex and nine months later their first child was born. Carl was excited to be a father but it was difficult for him. He worked at his father's shoe store and eventually finished school. After the baby was born Mandy enlisted in the Air Force and was stationed in California. The child lived with Carl and it was hard on the young family but they continued their exclusive relationship. Mandy was able to provide healthcare for the child but Carl declined healthcare. Mandy used Carl's last name on all her legal documents except for her military records. After ten years of military service, Mandy left the Air Force and moved to Perry Georgia and the couple began living together. During the past thirty years, they had two additional children, purchased a home together and share a bank account and finances. They claim that they have been married since prom night.
