Fraud
Adam bought an AlienWare gaming PC from his friend, Vicky, for $2500. Vicky told Adam that the computer was in good working order. Vicky knew, however, that the computer had suffered some damage when she spilled her Pepsi during a particularly contentious game of Overwatch and a computer technician had told her that the hard drive needed to be replaced and was likely to fail soon. Adam also bought two Xbox One games from Vicky, Professional Farmer and Soda Drinker Pro, because she said they were awesome.
After playing the games for a few hours, Adam decided the games were not awesome and, in fact, were rather boring. Adam also began to have problems with the computer after he used it for a few days. Adam took it to a technician, who happened to be the same technician Vicky had used. The technician recognized the computer and told Adam that he had warned Vicky that the hard drive was about to fail.
Two days later, Adam sued Vicky (a) for fraud in the sale of the game and (b) for fraud in the sale of the computer. Will Adam succeed on either claim? Explain separately as to each claim.
