FTE$-9.$ Generally, a practitioner may be sanctioned for any of the following except:

If the practitioner acts with a specific mental state or competency standard

If the practitioner is incompetent or disreputable

If the practitioner intentionally misleads a client so as to defraud that client

If the practitioner withholds information form the IRS that he or she believes in good faith is privileged
