Normal people walking around cannot just be searched by the government. The fourth amendment protects all people from unreasonable search and seizure by the government. A major case involving school and searches was T.L.O v State of New Jersey. This landmark case helped clarify what is allowed and what is not. The key word to remember in the fourth amendment is it only protects against unreasonable search and seizure. In this hallmark case a student referred to was smoking in the bathroom and this ended with her bag being searched by school administration. This case went all the way up to the US Supreme court but prior to that the NJ Supreme Court "Agreed with the lower courts that the Fourth Amendment is applicable to the conduct of school officials; also agreed that school officials may conduct a warrantless search of a student when they have reasonable grounds to believe that a student possesses evidence of illegal activity or activity that interferes with school discipline and order"( US Courts). Its important to note the US Supreme court agreed with the lower court's ruling. The courts also agreed that the 4th amendment does apply to school officials.
