SEXUAL HARASSMENT ALLEGATIONS AT A COMMUNITY-BASED NONPROFIT Background and Context TAC is an arts-based education and outreach nonprofit that provides services to the local gay, lesbian, bisexual, transgender and queer (LGBTQ) communities. Founded in the late 2000s, the organization achieved a moderately positive reputation in the community. A few years ago, the founder left and a new executive director (ED) immediately implemented a number of changes, including establishing a new senior leadership team, Board of Directors, branding strategy, and operational standards. Since then, the organization and its ED have received a number of awards, including being named, respectively, a "best" arts organization and a trailblazing leader by a prestigious local publication. Although the ED was recognized for his bold vision, he was also known for having a brash personality and a lack of organizational skills. As a result, turnover on the senior leadership team was high, with nearly 50% of the team voluntarily leaving each year for 3 years. Additionally, the ED's vision led to clashes with volunteers, many of whom felt the ED's demands were unrealistic and uncompromising. Given the lack of resources and volunteers, the internal work of the organization occasionally felt rushed and chaotic. Allegations and Investigation Last year, a member of the senior leadership team emailed the Board with complaints about the ED's behavior, including claims of sexual harassment and assault. The Board met with the volunteer, who detailed the following allegations: 1) The ED joked to others in the organization that the accuser and another volunteer had a sexual relationship with each other, an already known fact among staff; 2) The ED joked about the sexual orientation of a volunteer during a team meeting; 3) The ED inappropriately groped the accuser at a work event and said he would deny doing so if it ever came up In response, the Board informed the accuser that an investigation would be conducted. The Board sought the advice of external legal counsel and placed two Board members in charge of an internal investigation. The investigation included interviews with current and past volunteers, during which written notes were recorded. At the conclusion of the investigation, the Board found that the behavior in question did not violate federal law or organizational policy, and that sexual harassment did not occur. They released a statement retaining full confidence in the ED and committing to steps to ensure increased professionalism and accountability, including expanded policies and training related to sexual harassment. Community Reactions Soon after, the accuser posted his accusations on social media. Immediate reactions from the community were negative and severe, especially from members who had previous disagreements with the ED. These individuals began targeting current volunteers online with hashtags such as #youstandwiththeabuser. They also contacted local media and vendors that had partnered with the organization. As a result, a number of misleading and defamatory statements about the ED and the Board were circulated, damaging the organization's reputation, revenue, and volunteer capacity. The organization had to suspend some of its programming. The organization and several prominent members of the community remain committed to fulfilling TAC's mission and moving forward under the leadership of the ED. They have initiated new policies and training for all staff and volunteers. However, other members of the community continue to demand that the ED resign and the Board dissolve.
