Helen is on a train platform waiting for her train. A man runs up the stairs to catch the train that is leaving the station. He jumps from the train platform to the rear porch of the train where he is helped onto the porch by a railroad employee and drops the box he is carrying. The box contains fireworks. The box lands on the electrified third rail and explodes. Helen is injured when the scale next to her falls on her as a result from the explosion. In a suit Helen loses because she has a duty to retreat Helen loses because there is a lack of foreseeability of the events.
