1. You think your secret recipe is the reason for the wild success of your restaurant

There are many types of intellectual property and this specific example is identified as a recipe. Since the recipe is the reason for success in this case it is known as confidential business information. The best method to make sure no one copies or finds out the recipe is to keep a secret. In this case having each employee sign a non disclosure agreement and essentially making them "promise" not to say anything about the recipe is the best way to keep things a secret. Since employers ask the employees to keep information to themselves, in the event something has been leaked there can be serious consequences associated with that.

2. You try to trademark the name of your small restaurant chain. It is called Marvels.

In this situation the owner of the restaurant chain is trying to trademark their restaurant name. The name bears a striking similarity to the superhero movie creators "Marvel Entertainment Inc.". However, this name has already been trademarked like that. What the restaurant owner is trying to trademark is the word "Marvel's" so there is a difference between what they are trying to trademark vs what the movie company has already trademarked. However, this can result in problems as Marvel may have trademarked variations of their name to prevent others from using anything similar. The best way for the restaurant to trademark its name maybe be to trademark the logo or something else in relation to the name and the business. However, it doesn't hurt to try to trademark the name Marvel's.
