Quinn is a luxury home builder. Wade hires Quinn to build her dream in the City of Coquitlam. The agreement is that Quinn will complete the home by August 1, 2018 for $500,000.00 CAD. On June 1, 2018, Quinn tells Wade that the cost of lumber has gone up and that he needs an extra $75,000 in order to complete on August 1, 2018 otherwise he will not be able to complete on that date. Wade who needs to be in the home on August 1, 2018 agrees to pay him the $75,000. On August 1, 2018, the home is completed and Wade moves in. Wade then serves Quinn with a Notice of Civil Claim for the $75,000 for a breach of contract. Quinn comes to your law office to prepare a defense. Is there any legal principle that Quinn can use to have a successful defence? Explain.
