HI, can u help me solve this question?

QUESTION 3

The following are problem based questions where you need to set out your answers using the IRAC method discussed above. Your answers should incorporate the four headings described.

When answering this type of question, note the context in which it appears- namely, in the topic of intention to create legal relations. That gives you a clear direction about the legal issue you need to focus on!.

(a) Maud, an elderly woman, owns a house that is in need of repairs. Maud does not have the money required to pay for the repairs, which are substantial.

Maud's son, Bruce, is a tradesman and a very competent renovator and repairer of houses. Maud asks Bruce if he will do the necessary repairs, in return for which she agrees to transfer to Bruce ownership of one third of the property.

When the repairs are completed after two months of solid work, Maud refuses to transfer the promised one-third interest in the house to Bruce.

Required

Advise Bruce.

(b) George, an accountant, promises his daughter, Amy who is aged 20 and is completing the final year of an accounting degree, that he would pay her $200 a day if she worked in his accountancy practice each weekend.

Amy agrees to do so, giving up her part-time job as a waitress at a local caf, and has worked in the practice at weekends for a total of 20 days, but is unable to continue doing so because of study pressures.

George has not paid Amy for any of her work, and she now seeks your advice whether she may successfully claim the sum of $4,000 from George.

Required

Explain whether Amy has a legal right to bring an action against George for breach of contract.

( Consider any special facts that make this situation different from case example above of the student and the mother. Refer to cases where the presumption was successfully rebutted).
