You have been asked to prepare a class presentation on defences to intentional torts. Identify three primary sources relevant to this topic from your LAWS1052 text and materials, and outline the research strategies you would use to check that these are up to date. (5 Marks)
By primary sources I presume that they mean either cases or legislation. They could include:
- Civil Liability Act 2002 (NSW), s 52
- M'Alister (or Donoghue) v Stevenson [1932] AC 562
- Winterbottom v Wright (1842) 10 M & W 109; 152 ER 402
However, I am not sure about the second part of the question where it says outline the research strategies you would use to check that these are up to date. How would I do this for legislation (eg. Civil Liablity Act) and for the two cases mentioned above?
