Question:
Hockey Canada has been subject to a great deal of public scrutiny over the past year for failing to take steps to make changes within the organization. One of the biggest concerns has been numerous complaints of sexual harassment, sexual battery and sexual assault by hockey players.
Over the last year, there were many calls for leadership changes within Hockey Canada.
There have been lawsuits against Hockey Canada and many financial settlements of these claims, even complaints that never became a formal lawsuit.
1) Explain why Hockey Canada is involved at all in responding to civil lawsuits relating to sexual assault by its hockey player members. What is the legal concept implicating the Hockey Canada organization (as opposed to the lawsuits being brought only against the players)? What is the policy reasoning behind this legal concept and extending liability beyond the individual tort-feasor? Do you agree with the policy reasoning that extends liability in this way? Answer all parts of this question.
2) As an organization, what can Hockey Canada do to minimize risk of sexual assaults being committed by their members. If you were going to help create a risk management plan for Hockey Canada on this subject, what are two items you would include in the risk management plan? There is no "right" or "wrong" answer here. You can be creative.
