Even though that district is backlogged and she'd have to wait longer for trial, it's still the most appropriate venue under 28 U.S.C. 1391(b) since both defendants are located in New York and Gunther lives in that district. With our reading in mind from this week, I think that when deciding where to file, courts really do focus on the convenience of witnesses and parties, and all of Phoebe's witnesses (including Phoebe herself) are in the Western District.
