Unfair though it may seem, the State desires to use three-fourths (3/4) of Ms. Smith's property and turn it into a three-lane highway for public access through the county. The State Department of Transportation believes its plan and eminent domain action in this manner classifies it as a public good even if that sacrifices the convenience of an individual. Ms. Smith's property is valued at $700,000.00 without including her home. The total value of her home and property is $1,600,000.00. The State posted a notice on Ms. Smith's property condemning her new home and specifying public hearing dates for their use of eminent domain.
