An independent contractor is someone who contracts with an individual or an organization but who does not adhere to the same performance rules as an organization's employee. (Saylor, n.d.) Clean is not legally required to withhold income taxes from contractors. If workers agree to independent contractor status, it will mean that Clean does not have to pay worker's compensation premiums. This could be a substantial financial savings. Additionally, Clean would not be responsible for any damage incurred by the contractor if they were involved in an accident while on the job. All of these could potentially be large financial gains for Clean if the position were filled in a contractor capacity.
The position that Clean is looking to hire for is an IT position. This is an integral part of the organization, and it would need a very clear definition of what is required of the employee. If this position were a contractor position, the employee would not have to adhere to the same performance rules. If the contractor is given authority to make decisions and those decisions turn out to be contrary to Clean's vision this could be problematic. (Sherman, 2018) The roles for all employees should be clearly defined. Due to the nature of the position and the need for the employee to be accountable and held to company rules, I think George Tacy should be hired as an employee not an independent contractor.
