1. Rose Flanagan, age 55, is transferred out of the department of a predominantly Latino high school where she worked for 33 years because of reorganization. When a position becomes available in the department she reapplies. She is among 3 finalists. However, a 28 year old who speaks fluent Spanish is chosen for the position. Rose is told she was not chosen because they were looking for people who were energetic and flexible. A year later, another position opens, Rose reapplies. She is again one of the top 3 candidates, but she is denied the position to a 36 year old with Spanish fluency. Spanish fluency is not listed in the job description. Can Rose state a claim for age discrimination? Why or why not? -100 words or more, please.
