1)The Push-Me-Pull-Me Rod Company recently obtained utility patent protection as well as design patent protection on its new blind closing/opening mechanism.One of the patent claims includes a means for activating the mechanism and the patent itself discloses a knob arrangement.The Doolittle Doodad Company produces a closing/opening mechanism that uses a lever arrangement.Push-Me sues Doolittle for patent infringement.Push-Me:

a)loses because Doolittle has not literally infringed its patent because it uses a lever and not a knob.

b)loses because a lever is not the same as a knob and therefore not every element of the patent claim is found in the Doolittle device.

c)wins if the lever performs substantially the same function as the knob in substantially the same way to achieve substantially the same result.

d)wins if an ordinary observer would confuse Doolittle's mechanism with Push-Me's mechanism.

e)wins if Doolittle's device is the same as or equivalent to Push-Me's and an ordinary observer would confuse one device for the other.
