As a HR professional you have an ethical duty to have procedures that are perceived as fair (Cantano, Hackett, Wiesner, Roulin, & Belcourt, 2022, p. 55) and unbiased when hiring or dealing with disputes. In the area of hiring its important to be fair and use proper testing because the adverse reactions to selection tests and procedures may impair the ability of an organization to recruit and hire the best applicants (Cantano, Hackett, Wiesner, Roulin, & Belcourt, 2022, p. 55). Furthermore, when dealing if testing is unfair there may be legal repercussions such discrimination charges against the employer.
What principles set out by the HRPA/CHRP Code of Ethics or other Human Resources Professional organization apply in this situation?
Using the Code of Ethics from CHRP Canada the two that apply in this situation are P309 act impartially and P401 respect peoples dignity and rights. Firstly, with P309 it looks to endeavour to act in an impartial and unbiased manner and shall act in good faith towards all parties at all times (CHRP Canada, 2016) and this relates because with the new employment test visible minorities are not given an unbiased chance potentially because of their differing culture. Secondly, P401 states that the member shall respect the dignity and rights of all individuals (CHRP Canada, 2016) and the right not currently being respected is their human rights to be free from discrimination based on ethnic origin which is a protected ground within the Canadian Human Rights Act.

With our new employment test implementation at plant X, it seems our recruitment of visible minorities has dropped a drastically. We may need to review the test to find a cultural biases within it that has resulted in discrimination against visible minorities be it from ethnic origin, or religion. We do need to move quickly on this because there is a high potential for unsuccessful candidates that perceive the unfairness to pursue discrimination charges against (Cantano, Hackett, Wiesner, Roulin, & Belcourt, 2022, p. 55) against the company, which may also lead to fines from the Canadian Government for breaking the Canadian Human Rights Act based on the prohibited grounds of discrimination.
