Hypothetical Application of the 14th Amendment Due Process Clause The Legal and Ethical Environment of Business class abruptly came to an end. Grades were posted as follows: 1. White males received an A. 2. White females received a B. 3. Everyone else received a C. The above grades were further lowered as follows: 1. Students who are NOT Protestant, (Catholic, Muslim, Hindu, etc.) have their grades lowered two letter grades. 2. Students who have worn a baseball cap to class are lowered two letter grades. Apply the exact words of the 14th Amendment to the hypothetical grading scheme. Relevant part of the 14th Amendment: ...nor shall any state deprive any person of life, liberty, or property, without due process of law;... How is the state involved with the hypothetical grade distribution? What is being deprived? Life? Liberty? Property? What is the substantive argument that the state cannot assign grades as done in the hypothetical? Where do you appeal? If the grading system is not stopped on appeal; who do you appeal to next
