Apply a negligence IRAC based on the following scenarior: Sarah is a golf pro that is able to drive a golf ball 425 yards. The average golfer can drive a golf ball approximately 300 yards. In fact, Sarah holds the distance record for men and women at 425 yards. The next best record woman or man is 405 yards. The Walnut City Golf Driving Range (WCGDR) has netting that prevents golf balls from exiting the range within 400 yards of the tee. On the other side of the netting there is an unpaved path that has several signs that read: PRIVATE PROPERTY DO NOT ENTER! GOLF BALLS FROM THE DRIVING RAGE MAY CAUSE SEVERE BODILY DAMAGE OR DEATH. Wayne lives next to the golf range and attends Mt. SAC. Wayne is in the paralegal program at Mt. SAC and eventually wants to go to Michigan to become an attorney. Wayne can cut his journey to Mt. SAC 15 minutes by jumping the WCGDR fence and cutting though the golf range on the unpaved path. On this particular day, Wayne is late for his Mt. SAC Torts class and decides to cut through the golf range. Sarah, is at the range that day and wants to practice her drive and drives the golf ball 410 yards over the netting. While Wayne was cutting through the WCGDR he gets struck in the eye/head with a golf ball. One the way to the hospital, the Wayne's ambulance gets struck by Peter's car. Peter had a green light but doesn't see or hear the ambulance entering the intersection on a red light. The impact of Peter's car, causes Wayne to get thrown against the inside of the ambulance. Wayne suffers severe injury to his brain and can no longer function in college. He has incurred over $250K in medical bills and it is likely that he will need to have additional surgeries that could cost up to an additional $200K. The average pain and suffering awarded in most personal injury brain injury cases is 4 times the medical bills.
