In the sales contract, Harrison agreed that for a period of two years he would not engage in the business of bookkeeping, accounting, or tax practice within a 25-mile radius. Harrison then moved 100 miles away to Red Wing, Minnesota, and opened a new office. Harrison kept his home in Austin and continued to furnish bookkeeping and tax services for his old customers. Contracts with old customers were maintained by a telephone answering service at Harrisons Austin home. Harrison returned to his Austin home every week or two to obtain the information he needed to do the work. Information was also left with relatives who mailed it to his Red Wing office. Manchester sued Harrison for breach of contract.
