Law for the Business Enterprise Law 1101 Instructions: You are a first year associate at Islam and Associates. Please read the following facts from a potential client. Be prepared to address the questions asked following the facts. Cite all necessary legal analysis. Thank you. FACTS: Juicy Smooyay is a famous musician and actor part of the world famous band "You Can't Touch My Keys." He's also known for his activism within the LGBTQ community. Unfortunately for him, his manager has notified him that he's likely going to be phased out of the band on the next tour and his musical career is rapidly disappearing. In an effort to save his career he decides to orchestrate a publicity stunt so that people will feel sorry for him and which will force his band to keep him on the next door. He calls a few of his international friends (it's best to use someone not local) to ask them to participate in this ordeal by tying him up, calling him racist and homophobic slurs and "rough him up" a bit then leave him near the neighborhood Subway in exchange for $5,000 and sponsorship on their green card application. He's sure that based on his celebrity status the government will issue it expeditiously. His plan is that once they do this, he will file police report and immediately his fans will feel sorry for him which will support him coming back for the next tour. After numerous phone calls, and a private Instagram ad, two of his Instagram followers Qlabinio and Onwadinio (brothers) decide to take Juicy up on his offer. They respond that they will do it, but only if Juicy will also let them open up on his next tour with their duo of Bin & Din. In a moment of desperation, Juicy agrees. After the incident, everything is going as planned except about a month after he files the police complaint everything goes haywire. The police immediately find out it was all a scheme and now Juicy is not only dropped from the tour but he's also facing criminal charges. Considering his state of affairs, Juicy refuses to attend the Visa sponsorship meeting with the government which is a requirement of the brother's application. Unfortunately, the brothers are deported and their music career never takes off. 11. Was there a valid contract? If so, what are the terms of the Contract? (4pts) Juicy would've gotten away with it. However, his band's manager knew something was wrong so they paid Detective assigned to his case to find out what really happened. He was offered $20K in exchange for investigating leads that were provided by Manager based on people connected to Juicy. Manager made 2 payments of $5K, but refused to make any more payments once the brother's were identified and confessed. 2. Did Detective and Manager have a valid contract (3 pts) One Onwadinio's younger brother who's sixteen went to the local electronics store and spent nearly $10K worth of electronics to record the scene. He bought two camcorders, some recording information and other essential items to ensure Juicy's immaculate performance would be captured for the "Big Screen." Unfortunately, because of all the negative attention he never was able to publish the videos. In a fit of rage, he grabbed the electronics and threw them down the steps. He scooped up the products now shattered across the floor and tried to return it to the Store. 3. Can Onwadinio's Brother returned the damaged goods? Is there a contract between him and the electronics store? (3pts) Law for the Business Enterprise Law 1101 Instructions: You are a first year associate at Islam and Associates.
