Question:
In a decision in 2022, the U.S. Supreme Court overturned its earlier decision in Roe v. Wade, which had stood for more than 40 years. In Roe v. Wade, the Court had held that the right to choose to have an abortion came within the due process rights afforded in the Constitution, as it was a fundamental right to govern one's own body, The High Court recently decided that is earlier decision was wrongly decided, so that there is now no contitutional right to abortion. Justice Clarence Thomas also suggested during that decision that the Court should now overturn other decisios, such as the recent Obergefel decision which held that gay marriage was a constitutional right.
Discuss:
Do you believe that the principle of stare decisis is important in our society? Why/why not?
Did the Supreme Court adhere to the principle of stare decisisin overturning Roe v. Wade ?
How do Roe v. Wade and the Obergefel decisions underscore the importance of stare decisis?
How are/can citizens be affected by the Court changing course on abortion and gay marriage ? Is this fair and equitable ?
Should individuals who already had a abortion before the Courts decision be concerned about the possibility of criminal charges ? Explain specifically why or why not.
