In our text, you are introduced to the method by which international sales contracts are handled. Specifically, the book notes that "the United States has ratified the united Nations Convention on Contracts for the International Sale of Goods (CISG). The book also notes that parties to an international sales contract may "opt out" of the CISG by choosing the law(s) which they wish to apply to their agreement. Discuss which situation, either the application of the CISG or choice of law by the parties, you feel is best. Would your answer be different depending on the type/nature/size of the businesses engaged in the contract? Next, review Chapter 17. In so doing, you should note that the UCC Statute of Frauds drastically changes the common law Statute of Frauds Doctrine. Discuss some of these differences. Does the UCC or the common law seem to be more equitable? Should consideration be given to abolishing either the UCC or common law versions in favor of the other, and uniformity? Or, in the alternative, should the distinction remain in full force and effect? Discuss these issues fully, responding to the postings of your other classmates.
