However, Plaintiff sent the letter of acceptance on the 7th through fax but the ink got over in the fax machine of the defendant. Defendant received Plaintiff's acceptance on September 9thwhen Ink was loaded again. 7thand 8thSeptember were normal working days but the defendant did not load in the ink in the fax machine. Defendant sold the wool it had originally offered to Plaintiff to a third party on September 8th. Plaintiff brought suit against Defendant for breach of contract in Delhi.
