After obtaining a BA in business administration from CUNY, Patel has worked at Indo Ads for one year on H$-1$B as a market research analyst. Patel wants to apply for a green card as soon as possible so that she can receive the green card before she exhausts all six years of her H$-1$B visa. Indo Ads has a company policy that says it will petition for employment$-$based immigration after an employee has worked for more than one year and has displayed the $$skills necessary to further the interests of the department.$$

Henry, Patel$$s department manager, recently informed her of his plan to leave the company after one more year. Henry told Patel that he was impressed with her work and that he wanted to recommend her as his potential replacement. Henry advised Patel to enroll in a one$-$year, part$-$time MBA program at Cornell so that she could qualify for the manager position, which requires an advanced degree and two years of experience in the department. Henry also added that he thinks becoming a manager could help Patel obtain a green card more easily.

George, Patel$$s husband, is from England and has a Master$$s degree in biomedical engineering from Cornell. He has published several scholarly articles, some of which he was invited to present at annual meetings of the Biomedical Engineering Society. George recently served as guest associate editor for a journal on biomedicine, where he reviewed several articles for publication. He has been working for a company called Bio Land for one year on H$-1$B as a biomedical engineer. Bio Land does not have an immigration policy.

Given these facts, write a memo laying out the different green card options for Patel and her family. If you need more facts, what would they be and why are they relevant? Which option would you recommend, especially given the wait times in the Visa Bulletin? Also, provide a brief assessment of how viable Henry$$s proposal is for Patel$$s immigration purposes.
