Mr. Barker entered into a written contract with ACME on January 1, 2018, in which Mr. Barker was to pay $35,000 and ACME was to provide him with 30,000 dog creates. The dog creates were to be 1 1/2 feet tall, 1 1/2 feet wide, and 2 1/2 feet long. They were to be delivered on or before March 1, 2018. Mr. Barker made payment in full on January 15, 2018. A copy of the written contract is in our file, but you will not need it to write the Complaint. The contract was signed by Mr. Barker and Adam Smith, the Director of Sales at ACME. The contract was signed in Baltimore County, Maryland and ACME's principal place of business is 234 Acme Drive, White Marsh, Maryland 21222. ACME first delivered 300 dog creates that were 1 foot, by 1 foot, by 2 feet on February 19, 2018. They were promptly returned to ACME, as they did not conform to the description of what was purchased. Since that time, ACME has refused to refund Mr. Barker his money and has not been able or willing to provide the products requested. At this time, Mr. Barker is no longer interested in obtaining the creates, but would like his money back. We also want interest both pre-judgment and post judgment at the rate of 10% per annum, based on the provisions of the contract.
