Sometimes their actions are not enough to prove premeditation, as you must know what they were thinking at the time. It's difficult to determine a person's thought process. Knives are really tough. Many, many Americans carry a knife in their pocket every day. I carry one and use it for a variety of reasons. Honestly, I use it at some point almost every day. It might be to open a letter, cut up some food, or even as a makeshift screwdriver. Now, lets say I end up in a confrontation and use my knife as a weapon. A good prosecutor is going to make it look like I was "looking for trouble" because I was carrying a knife. A good defense attorney will explain it as I was simply carrying it as I normally do. It was part of my attire. (Obviously, I'm going a bit off topic here and comparing apples to oranges. My goal is to show you how premeditation can be skewed) Does that all make sense
