Kenny Obero is an international footballer from Ghana. Kenny decided that he wanted to play professional football in Malaysia. In May 2020 he appointed Bobby, the owner of a footballer’s agency, to act as his agent. Kenny requested Bobby to negotiate a deal with a leading Malaysian football club on his behalf. It was agreed that he would pay 10% of his monthly salary as commission to Bobby if he arranged to sign him with a Malaysian club. In July 2020 Bobby successfully negotiated a contract with PJ Lions (“PJL”) for Kenny to play for the club for a term of two years. At the same time, it was agreed between PJL and Bobby that PJL would pay Bobby a fee of RM10,000 for obtaining a work permit for Kenny. Such a permit was needed since Kenny was not a Malaysian citizen. Bobby obtained a work permit for Kenny and PJL paid the RM10,000 agreed fee to Bobby. Bob did not tell Kenny about this arrangement. Kenny subsequently signed and played for PJL and began paying the 10% commission due to Bobby under his agency contract.
A year later Kenny found out about the work permit arrangement that Bobby had with PJL. Advise Kenny of his rights and remedies as against Bobby under the law of agency.
