Many of your readings for this module discuss the concept of "public health" and "public health emergencies," including the role of the state in public health. Using Jacobson and including at least two other readings, how has the the concept of public health, and the state's role in public health, evolved over time? You are a state-level judge in Massachusetts in 1906, the time immediately after the Jacobson v. Massachusetts decision. Unfortunately, another outbreak of smallpox is occurring in Cambridge, Massachusetts, and Cambridge is again requiring vaccination of its citizens. A citizen of Cambridge, Johnson, has refused vaccination, and a suit very similar to Jacobson has found its way to your desk. However, there are some factual differences in this case. First, Johnson has documented proof that a prior vaccination several years earlier caused a severe, life-threatening reaction. Second, given their experience, health officials in Cambridge have caught this outbreak at an earlier stage, and it is not yet as widespread as it had been when Jacobson was decided. Knowing that Jacobson is now legal precedent, you must now apply it to decide the outcome of Johnson. What is your holding, and why?
