Miriam has decided to sell her Xbox in order to raise money towards her hiking holiday. She decides to write to her friend, Devendra, who she has not spoken to since he moved to the north of England two years ago. Miriam posts a letter to Devendra on Monday offering to sell the Xbox to him for £300. Unknown to Miriam, Devendra has been suffering with a deteriorating eye condition which has resulted in total blindness. It is not until Thursday, when Devendra's wife opens and reads Miriam's letter to him, that he becomes aware of Miriam's offer to sell the Xbox for £300. Devendra immediately telephones Miriam and leaves a message on her answerphone, stating: 'Hi Miriam, lovely to hear from you. I would like to buy your Xbox, but £300 is too much. Will you accept £250? Please use the email address you have for me and let me know as soon as possible. Thanks.' On Thursday evening, Miriam listens to Devendra's telephone message. She immediately sends an email to Devendra, stating: 'Hi Devendra, thanks for your message. If £300 is too much for you, I'll accept £250. Please get back to me before Saturday.' Devendra reads the email using his text-to-speech computer software on Monday morning. He immediately emails Miriam, stating: 'Thanks, Miriam. Yes. £250 would be great. I'll put a cheque in the post for you. Please send me the Xbox upon receipt of the cheque.' As Miriam had not heard from Devendra by Saturday, she sold the Xbox to her friend Nardia on Sunday for £200. The following Monday Miriam reads Devendra's email and receives his cheque on the Wednesday.
