IMM 102 Mock Hearing Assignment Joseph Miller is a citizen of Iraq. After completing high school in his hometown of Abu Al Khasib, near Basrah in southern part of Iraq in 2004, he went for post secondary education in United Arab Emirates (UAE), where he completed a degree in 2007 in IT Technology at the Zayed University: College of Technical Innovation in Abu Dhabi. While there he found employment for an American company in UAE, Halliburton -KBR, providing IT support as an IT specialist; and as a translator. In April 2008 Joseph received an anonymous threatening phone call, in his Iraqi dialect, stating that 'they' were aware that he was working for the enemy, that he was an American lover and sympathizer, and threatened that he would be killed for being a traitor. Joseph alleges that he was aware of others working for Halliburton-KBR who had also received threatening calls, some of his co-workers had even been physically beaten for their affiliation with the American company, and he heard of others who for killed for their professional association of Americans in the Middle East. Joseph provided an 'on-line' news article of two Americans killed in UAE and Saudi Arabia, according to the article, for their connections with Americans in the Middle East. Joseph resigned his position with Halliburton-KBR two days after receiving the phone call and returned to Iraq on April 17, 2008. On May 5, 2008, Joseph's brother, Thomas was kidnapped and was 'missing' for five days. Joseph and his mother went to the local police station and reported Thomas missing on May 5, 2008. On May 10, 2008 the body of Thomas was dumped on the family property. He had bruising on his body and had been shot in the chest, and left with a note stuck in his shirt pocket. It read 'translator' 'American lover' and 'traitor' and contained threats to the rest of the family. Joseph stated that he believes his brother was mistaken for him. Thomas is one year younger than Joseph, and the brothers are similar in appearance. On May 11, 2008 Joseph and his mother went to the police in Basrah and filed a report regarding the murder of Thomas. Joseph provided into evidence a copy of the police report filed on May 11, 2008. He also provided pictures of Thomas' body left on the front of the property, and a photocopy of the 'note' left on Thomas's body. Joseph and his mother buried Thomas next to his father, on May 18, 2008, following an autopsy and short police investigation, which was declared closed on May 31, 2008. Joseph provided a copy of Thomas' autopsy, stating he was deceased as a result of a gunshot wound to the chest, shot at point- blank range. Joseph's mother did not receive any final police report regarding the murder investigation. Joseph testified that three days after his brother was buried, his mother received a threatening phone call and stones were thrown at the front door and window of the family house, breaking glass and causing damage to the door and walls. Joseph and his mother went to the police on May 21, 2008 and filed a report regarding the house vandalism, and the phone threat. Joseph testified the police promised to investigate, but they did not do anything further for Joseph and his mother.
