Brooklyn Man Sues Former Employer for Weight Discrimination

Your memo should summarize the facts of this case, and address the following questions in memo format

1. What is a contract employee and what is an at-will employee? Which one would Seth Bogdanove be?
2. Does federal law prohibit employment discrimination on the basis of excessive weight? Go through what categories the federal government does prohibit discrimination against (see your text). Which law would be the closest to affording protection to excessive weight, and do you think that law covers it?
3. Does the state of New York prohibit employment discrimination on the basis of excessive weight (dig a little on the internet)?
4. Does the owner of the store, Jerry Greenberg, have a right then to terminate Seth on his first day of work?

What implications does this case have on other areas of law, particularly associated with the ADA outside of employment? If this category is covered by the ADA, how might airlines have to respond? Movie theaters? Think.... :-)
