Moore’s on-site supervisors accepted the non-conforming cabinets and had them installed, believing that the restaurant owner would not know the difference. The owner did know the difference, however, and insisted that the cabinets be replaced. Moore replaced the cabinets and refused to pay Basepoint. Basepoint filed a suit to recover its price.
