Mrs. Banks operates a small Gift & Craft Items Store in New Kingston.Sandy. who is the store clerk would normally work from 9 am to 6 pm from Monday to Saturday? On Tuesday February 10 there was heavy continuous rainfall in Montego Bay resulting in massive flooding throughout the town. several businesses in the Town were severely affected including the Gift store. The roof and doors were severely damaged making it unsafe to leave the items in the store overnight. Several store owners had started seeking alternative locations to put their products into safe keeping.

Sandy made several attempts to contact Mrs. Bank to inform her about the happenings but without success. She then decided to take the gift items to a nearby safe keeping storage facility owned by Mr. Pang. He had also provided transportation to take the items to the location. Sandy had also purchased some additional gift items on credit from Craft Supplies Ltd, earlier in the day, because she thought they were reasonably priced and would make creative gifts to be sold on the upcoming Valentine's Day

On Wednesday February 11, Mrs. Banks on hearing the news about flooding immediately contacted Sandy. When she heard about the storage and transportation costs she became adamant and refused to pay contending that Sandy acted without getting instructions from her. Ms. Banks also indicated that she will not be paying for the gift items from Craft Supplies Ltd because she did not give Sandy permission to purchase such items.
