Question 5(1 point)
Henry Spoon and Marsha Fork, of Fork and Spoon, Inc., were real estate developers.
At lunch one day they meith a co-worker, Joe Spatula. After a conversation,
about Spatula's property, they verbally entered into a contract to purchase a $1.7
million dollar property in West Palm Beach. Spatula accepted their check right away
and they both shook hands and said "deal".
The only evidence of their agreement was the check. Ten days later, but before
closing, Spoon and Fork hired contractors to go to the property to start digging to
begin to build a luxurious set of condos. When the contractors arrived, they met "do
not trespass signs and a fence was wrapped around the property and a watchman
who stopped them from entering therein. They immediately called Spoon and Fork
and told them what was going on. Spoon then called Spatula who did not returned
his calls. The next day they received a copy of their check that they wrote to Spatula
and the check had words scribbled on it that said, 'return to issuer'. He later called
Spoon and Fork and said I have a right to change my mind, we did not have a valid
contract
If Spoon and Fork seek to enforce the land sale against Spatula, they will:
not succeed because Spatula has a right to change his mind
succeed because it was a valid contract because it has both of their signatures
not succeed because the sale is against the statute of frauds-void
not succeed because Crayon was a co-worker and they should not have contract
with him
