MOOT COURT PROBLEM-III On the banks of river Pranahitha, A perennial river, at a point where there is a thick forest and few villages with bounty of flora and fauna and also some endangered species of wild life, the government of X backed by Central Government proposed to construct and develop a few industries such as (1) paper (2) Rexine (3) Plastic, because these villages are backward and underdeveloped and are leading to imbalanced regional development. The construction of such industries shall develop the area and generate lot of employment and other subsidiary means of livelihood. But an environmental organization based in, Ilyderabad NATIONAL ENVIRONMENTAL PROTECTION SOCIETY (NEPS), approaches the Hon'ble Moot Court in Public Interest Litigation, seeking a relief to stop the construction of such industries as these industries shall pollute the environment and disturb the ecological balance The State of X and the residents of the village contend that these industries shall provide them with means of livelihood and as they are entitled under Directive Principles of State policy and Fundamental Rights of Indian constitution.
