On March 1, Harry wrote Peter in a signed letter offering to supply five million bricks at the rate of $28.00 per thousand, and expressly agreeing to keep the offer open until May 1. On April 1, Harry wrote Peter withdrawing his proposition and this letter was received by Peter on April 2. On April 4, Peter mailed a letter to Harry stating that he accepted the offer and renounced the attempt to withdraw the offer, in as much as it was to stay open until May 1. When called upon to deliver the bricks, Harry or his representatives refused to do so and Peter sued.
