On May $31$st$,2010$ Kalamazoo, Michigan, college student Justin Kurtz woke up and asked, "Dude, where's my car?" The answer, simply enough, was that his car had been unlawfully towed despite having the proper parking permit.Like any active$-$minded college student, he aired his problems on Facebook. And now faces a $750,000$ dollar lawsuit. The New York Times of June $1,2010$ explains the towing company is seeking this amount on the grounds of defamation claiming that the facebook page Kurtz created, entitled "Kalamazoo Residents against T & J Towing", has cost them business. Unfortunately, Kurtz's predicament is not unique. He was hit by a SLAPP, a Strategic Lawsuit Against Public Participation. NPR on August $11,2010$ defines SLAPPs as frivolous lawsuits filed by corporations against private citizens who speak out in opposition to them $-$using the prohibitive cost of a lawsuit to intimidate citizens into silence. Anyone who has commented on Yelp, Facebook, Twitter, Angie's List $-$ evep anonymous blogs $-$ is vulnerable to these lawsuits. And in $2010$ alone, the average number of SLAPPS filed in the United States was over $1,727.$ SLAPP threatens one of our most cherished civil rights and undermines our basic notions of accountability.
