On, January 15, 2023, our client loaned her laptop computer to her best friend, Beatrice Carter, whose computer became inoperable due to a computer virus. Beatrice Carter works as a real estate agent and greatly depends on a computer for her work. Beatrice Carter uses a computer to look up real estate listings, download property profiles, and all of the sales contracts are now done electronically. Our client understood from Beatrice Carter she would only need to borrow her computer for about a week.

After a week passed, our client called Beatrice Carter several times to inquire when she intended to return her computer. Beatrice Carter never returned any of our client's telephone calls.

On January 25, 2023, our client sent Beatrice Carter a letter demanding that she return her laptop computer. Beatrice Carter never responded to our client's letter. At this point, our client reasonably believes, based on the circumstances, that Beatrice Carter does not intend to return her computer.

Our client purchased the computer four months ago for $2,500. She has the receipt to substantiate the cost. The laptop computer was in perfect condition and working order when it was loaned to Beatrice Carter.

Although our client could file her action in small claims court, she prefers to file her action in Superior Court because it will allow her to undertake discovery. Our client and Beatrice Carter both live in Orange County. The proper venue for this action is the Central Justice Center located in Santa Ana.
