Overeasy entered a contract to deliver 5,000 widgets to E. Male on January 10^th.  On December 15^th, Overeasy called Male to inform him that the union at his factory just went on strike and that his company would not be able to deliver the widgets on time.  Male needed the widgets, so he ordered 5,000 widgets from another supplier. On January 3^rd, Overeasy called and said that the strike was settled and his company would, in fact, be able to deliver the widgets.  Male said, "After you called last month, I decided that you breached the contract, so I ordered from someone else.  I won't accept the widgets from your company."  Overeasy called his company's attorney and asked, "How could we breach the contract in December if we didn't have to perform until January?"
