Students are required to answer a three (3) part case study using the IRAC (Issue, Rule,Application andConclusion) method of answering case studies.

The purpose of this assessment is for students to research, locate and reference appropriate lawand demonstrate a working knowledge of the law relating to contract law issues by analysing basic law scenarios and applying legal principles to advise on likely legal outcomes.

DETAILS

Read the case study below and response detailing IRAC for each of the following 3 contracts.

Barbara is a successfulbusiness woman. Her well-known business makes and installs office furniture and equipment in large organisations. Owing to her success, she is often subject to pressure when negotiating business deals, as other parties are aware that she can often afford to pay large sums of money. Barbara accepts that this is part ofbusiness, butis particularly concerned in relation to a few contracts.

Contract 1

Contract oneis for the sale and installation of office furniture. Tobias, the buyer, has sent Barbara a personal email which states "You must sell and install top of the range furniture in our offices at cost price or your family will be in danger. Barbara went ahead and did what Tobias asked, because shefelt like she had no other alternative but to do so in order to protect her family.

Contract 2

Contract twois between Barbara and her lawyer. Barbara's lawyer has been persuading Barbara toenter intoa contract which she feels isn't very advantageous to her. Barbara's lawyer has pestered Barbara over a sustainedperiod of timeandBarbarahas felt pressure to take the contract in order to keep a good working relationship with herlawyer.

Contract 3

Contract threeis between Barbara and one of her suppliers. Barbara desperately needs the materials from the contract in order to use them in another contract. The suppliers are refusing to give Barbara the goods unless she pays them double the price. There are no other suppliers of these goods, therefore Barbara pays the price.
