Pablo Painter agreed, in writing, to sell his new painting entitled, "Nude Ascending an Escalator" to Richie Richman for $250,000. A few days later, Pablo tried to patch things up with his estranged lady friend who refused to move back in unless Pablo gave her the painting. Pablo delivered the painting to his lady friend and she moved back in to his garret. Richman sued Pablo for breach of contract.
