You are the contract manager for trucking company EZ Trucks Pty Ltd ("EZ"). EZ has been
quite successful recently. It has 25 employees and a turnover of around $5 million per year.
EZ wants to make sure that it keeps up to date with employment law and matters and to
ensure that it has proper employment contracts, policies and procedures. It does not want
to have any claims made against it at the Fair Work Commission - the government agency
that deals with employment complaints.
CEO of EZ, Ryder Long, googles 'Fair Work Commission' and at the top of the search results
he sees the following advert by On Guard Pty Ltd:

Ryder calls On Guard to enquire about the free advice service and speaks to salesperson
Maida Tupp. Maida says that the free service is for businesses that subscribe to On Guard's
services and the free service is an add-on to this.
Maida says that in return for a monthly fee, On Guard will provide all employment
paperwork and polices which will be updated every 3 months. They also will then provide a
free phone advice service 24 hours a day, 365 days a year. Maida says that the best deal is a
5-year subscription because the price is cheaper and EZ will be listed as a priority customer
in On Guard's monthly newsletter.
Whilst Ryder is annoyed about the lack of a truly free service, he considers that since On
Guard is affiliated with the Forir Work Commission and he can cancel at any time, he may as
well sign up. He signs On Guatrd's Consulting and Advice Contract containing the terms
below (see below).
After a year of paying the monthly subscription, Ryder is not happy with On Guard:
The paperwork and polices, whilst excellent, were only updated every 6 months.
The phone advice service, though able to be called 24 hours a day, 365 days a year
had a bot responding after business hours that ultimately refers the caller to the Fair
Work Commission website.
The monthly fee for a 5-year subscription was cheaper than a 2 or 3 year
subscription but only by $10 per month!
