Question:
Partner Carter is preparing to respond to a Complaint filed against one of her client's. Her client has been training to become a professional boxer. As part of her training, she participates in a boxing club, known as "Fun Fighting Club," every Saturday night. Fun Fighting Club is an informal association of individuals who pay a monthly fee to the owner of a vacant warehouse who has set up a boxing ring for the members to participate in informal boxing matches once a week. The monthly fee is paid in advance of each month by an automatic withdrawal from each member's bank account. Membership is limited to fifteen members. Membership is now full.
Two years ago, the client participated in a boxing match with Sammie Fae. This was Sammie Fae's first boxing match as a new member of the club. During the boxing match, the client punched Sammie Fae in the stomach and caused severe bruising to her stomach.
Two weeks ago, the client received a Complaint from Sammie Fae suing the client for the torts of assault and battery due to the bruising that occurred. The client has now shared the Complaint with Partner Carter
Carter wants me to practice my research skills. She has asked me to review the law in the jurisdiction in Maryland regarding possible defenses that could be used to defend against the causes of action raised in the Complaint. I must keep in mind that this is a CIVIL legal dispute, not a criminal dispute. Upon completion of my research, what following as applicable in the state of Maryland:
- What are two potential defense that could be raised if all elements of assault were met.
- What are two potential defense that could be raised if all elements of battery were met.
