Peter (P) was renovating a 1967 Chevrolet Super Sport automobile. He had finished
overhauling the engine and transmission, and had fully restored the interior of the car.
He had also completed necessary body work and painting of the car. He finally wanted
vintage wheels and tires to finish the total effect of the car.
Peter therefore went to Ace Race and Sport (ARS) and purchased wheels and tires for
the car that had the look of those used in the mid 1960s. The wheels that Peter
purchased were identified as Wheel-Co Model A-1 wheels. The wheels manufactured
by Wheel-Co (WC) had been sold by Wheel-Co to a distributor named Wheels R Us
(WRU) who had then sold them to All Wheels (AW) a wholesaler who then sold them to
Ace Race and Sport.
Peter installed the new wheels and tires on the car and the next Saturday night drove
the car to a municipally sponsored public raceway. He paid his fees and got in line to
run the car through a timed quarter mile straightaway course. Peters turn finally came
and when the lights turned green he sped away down the track.
However, as he approached a speed of approximately 90 miles per hour, the front tire
on the drivers side of the car hit a pothole. The left front wheel was severely dented
when the tire dropped into the pothole. As a result Peter lost control of the car. The car
spun and rolled over three times before coming to rest. As a result the car was
demolished and Peter sustained severe injuries.
As a part of the investigation into the accident, it was discovered that the specifications
for the metal alloy used to make the wheels were incorrect thus causing the metal to be
too soft. This characteristic caused the wheel to dent when it hit the pothole. It was also
learned that Wheel-Co had learned of the alloy problem prior to the sale of the wheels
by Ace Race and Sport to Peter but that Wheel-Co had taken no action.
