Plastic Pty Ltd decides to build an additional plastic moulding plant near their main plant in order to increase the volume of products they produce a day in order to meet growing demand. The Company assigns the responsibility of the programme to a senior civil engineer Within the company, Mr L$.$ Zama.The project manager called for tenders and appointed The Shock Pty Ltd to carry out the construction of the plant and International Iron and Steel Pty Ltd to install the different machinery that is required in the new plant.

Mr Zama appointed two project managers namely Ms H$.$ Shila and Mr A$.$ Pluma who are works of Plastic Pty Ltd to help with the completion of the project. They report to Mr Zama and they are obliged to work every week day from $08$:$00-15$:$00.$ Ms Shila is responsible for the construction of the building and Mr Pluma is responsible for the installation of the machinery inside the plant. The International Iron and Steel Pty Ltd have appointed Mr Tony to carry out the duties. He $($Mr Tony $)$ have his own vehicles and tools that he uses to provide the services and he determines his working days, number of hours that they come to do their work at the plant. The Project Manager Mr Zama decides to discontinue the services of The Shock Pty Ltd because he was not happy about the quality of work that they were doing. The owner of the Schock Pty Ltd decides to approach the CCMA to report this case as unfair dismissal from the work
