1. Under Ohio Law, businesses or senders of spam emails need to include the business name, business address, and the business email address within the spam email. The spam email to the recipient must also contain an opt out option for the recipient who wishes to no longer receive spam emails from the sender. The opt out option should have the same text size as the text contained within the spam email so that the recipient can easily identify it. The spam sender is restricted from misleading spam recipients of who the spam sender is. An example of this would be providing a fake email address in the spam email and using multiple email addresses to send the spam emails.

A penalty that a spammer could receive is if the spammer does not disclose their company name, address, or provide an opt-out option for receiving future spam emails, the recipient can bring a civil suit against the spammer for each act and receive one hundred dollars for each violation. The total violation amount cannot exceed the maximum of fifty thousand dollars in the State of Ohio. The recipient can be reimbursed by the spammer for legal fees for initiating the lawsuit as well.

2. I receive spam emails weekly in my personal email inbox and my work email inbox. For the most part, I simply ignore the emails or delete them if I can tell by the subject line, body of the email or sender that the email is spam. If a spammer is legitimate and is continuously sending me emails, I look for the unsubscribe or opt-out button in the spam email to stop the flow of spam emails.

If the spammer does not comply the recipients wishes or provides fictitious details within the spam email, then there are penalties that the state of Ohio can enforce.
