Kadlec pp. 310 is a decision by a federal court in a lawsuit brought by a plaintiff located in the state of Washington on a question regarding Louisiana state law. Can you explain why the case was filed in Louisiana and why Louisiana law rather than the law of Washington applies?

The US Constitution states that federal courts have jurisdiction over cases in which the parties to the lawsuit are citizens of different states/ countries. So, the defendants, which are Louisiana Anesthesia Associates, the shareholders, and Lakeview Medical are based in Louisiana, which gives Louisiana courts jurisdiction over the case.

"For a court to exercise diversity jurisdiction, the amount in controversy must exceed $75,000 and complete diversity of citizenship must exist. Complete diversity of citizenship occurs when no plaintiff and defendant are domiciled in the same state (diversity jurisdiction, 1992)." In this case, the controversy exceeded $8 million and the plaintiff and defendant resided in Washington and Louisiana, respectively so the court was able to exercise diversity jurisdiction in the state of Louisiana.
