You have invited some friends to your backyard for a barbecue. While you are cooking steaks on the grill and talking to your friends, the steaks catch on fire and the fire spreads to your shirt. You are afraid that you will get badly burned and, in panic, you carelessly throw the sharp knife (that you were using to cut the steaks on the barbecue grill) to the side where it hits one of your friends (Janet) in the arm. Janet sues you for the tort of Negligence. (a) Will Janet likely be able to establish that you breached the standard of care? Please explain your answer fully. (2 Marks) Now assume that Janet goes to the hospital and that the emergency nurse carelessly provides the wrong treatment to Janet. (There are clear guidelines that an emergency nurse must follow for this type of injury, and the emergency nurse did not follow these guidelines). Janet develops a serious infection. Further assume that Janet would have developed the same serious infection (to the same extent and in the same manner) even if the emergency nurse had been very careful and had followed all of the guidelines. (b) Will the careless emergency nurse be liable for Janet's serious infection? Please explain your answer fully. (2 Marks)
